Practices in interviews with immigrants: Legal implications

Project goal:
Share professional experience in the interviews conducted with immigrants, with special regard to the legal consequences of interpretation, in the V4 countries and Ukraine. Create a comparative study of national reports on practices during the interview (interview), which will be available in English, Polish, Hungarian, Ukrainian, Czech and Slovak.
Detailed description of the project:
The V4 countries have similar experiences regarding immigration policies, treatment of foreigners and related challenges. In connection with the maintenance Shengen border Ukraine border is a key partner in the immigration procedures.
During interviews with immigrants in the verification of their authenticity are different. Misunderstandings between the parties to the interview may stem partly from their different cultural and social backgrounds, as well as the process of interpretation. Lack of knowledge and skills during the interview may have serious long-term immigrants for legal consequences. Activities of this project is therefore directed at improving the legal and cultural awareness and prevention of undesirable practices during interviews with immigrants.
Workshop with representatives of nonprofit organizations that provide legal assistance to immigrants - Polish and the Hungarian Helsinki Committee for Human Rights, a Czech organization for aid to refugees, Caritas Ukraine and Bratislava League for Human Rights will enhance cooperation in several areas:
- Exchange of experience regarding professional practice during the interview
- Focus on identifying the most common errors in interpreting
- Analysis of routine intervention of those who conduct interviews
- Preparation of educational materials and recommendations for professional standards in the conduct of interviews with immigrants
These activities will be electronically processed, translated and distributed in the V4 countries and Ukraine.
Target groups and benefitujúce:
Solicitors, interpreters, staff migration authorities, police personnel, judges, civil servants in touch with immigrants, migrants, asylum seekers.
Expected results:
The exchange current information partner organizations on standards of V4 countries in the management interview, transnational cooperation of NGOs in implementing procedures to define professional standards.
Development of reference material for staff and non-state sector, who run an interview with immigrants.
Reducing unintentional misunderstanding and lack of findings of fact in cases involving immigrants.
Distributing comparative study on the current state of interpretation and national reports in English, Polish, Hungarian, Czech, Ukrainian and Polish.
Linking with other relevant projects with the continuation of mutual cooperation.
Contributing to raising awareness about the rights of immigrants in civil society.

Ukrainian Law «On refugees» and
international act.
4. Help
in involving
international organizations
in the field of protection of the rights of refugees and asylum
seekers in order
to furtherfast
decision of the applicant (unaccompanied minors, families
with children, the elderly, or those that
require special form of protection and care, treatment, etc.).
5. Assisting
clients in writing
applications for asylum in Ukraine.
6. Legal
support case of
the applicant.
Homecare Project
Homeсare Program, implemented byCharitable Foundation ‘Caritas’ MGCD from 2004, is specialized inproviding of care for people at home. This care includes providing ofcomplex medical and social help for elderly people and other who needsocial support and care for improving the quality of their life. Thishelp covers physical and psychological; social and material needs ofpeople.
Home Care Program staff together withrepresentatives of health care institutions, departments of socialcare, municipal service officials is looking for lonely disabledpeople, providing evaluation of their living conditions and makesdecision about the necessity of providing medical and social homecare services. Program staff also establishes relations withappropriate institutions and organizations for providing medical andsocial care of these people. Special agreement is signed wheremethods of providing services, their conditions, length andperiodicity is determined.
As by now program is realized in 11cities of Ukraine. More than 50 people are involved in it that livesin Uzhgorod city. Project is funded by international donors and localpatrons.
Завершення міграційного проекту

05 грудня 2008 року завершився проект «Зміцнення потенціалу в сфері захисту та підтримки шукачів притулку та біженців на Закарпатті/Україна», який виконувався Благодійним фондом «Карітас-Caritas» Мукачівської греко-католицької єпархії з 01 січня 2007 року. Це проект був фінансований ЄС разом із Міністерством внутрішніх справ Австрії та Хоум офіс Великобританії. Виконавцями цього проекту разом із Благодійним фондом «Карітас-Caritas»Мукачівської греко-католицької єпархії були Карітас Австрії та МФОЗНС «РегіонКарпат» (NEEKA).
Під час виконання проекту була надана юридична та соціальна допомога декільком тисячам мігрантів, шукачів притулку та біженців. Було проведено декілька семінарів, конференцій та круглих столів присвячених проблемам мігрантів, шукачів притулку та біженців.
Information about MBU
The Migration Bureau Uzhgorod (MBU) is a
department of the Charity Foundation Caritas of the Greek-Catholic Diocese of
Mukachevo. MBU is providing legal and social assistance to refugees, asylum
seekers and migrants since 2006. MBU has been founded through the co-operation
of Caritas Austria and Charity Foundation Caritas of the Greek-Catholic Diocese
of Mukachevo, implementing the European Union funded projects named “The
Establishment of Migration Management System in Zakarpattya/Ukraine” (started –
June 2004, finished – December 2006) and “Enhancing capacities in the filed of
protection and support for refugees and asylum seekers in Zakarpattya/Ukraine”
(started – January 2007, finished – December 2008).
